Pls. correct the statement if wrong:
If the Principal Applicant doesn't go, and the Partner goes to NZ to test the waters, and he/she finds a fulltime job, he can apply for Work Visa and can legally work there on that basis. From there, he/she can re-apply for WTR starting with EOI with him/her as PA, depending on the type of job (LTSSL) he has. Or as Work Visa holder, his spouse can later join him/her on visitor's visa and start his/her own jobsearch. Circuitous but workable? |

to kabayan:

if the partner of the PA goes to new zealand, on what visa does he intend to go on?Tourist? or the approved WTR? Is the partner visa even valid if the Principal Applicant does not use his/hers? The Principal's Visa is skills related which is what NZ wants. Why would immigration let in an open visa if it does not go hand in hand with a skilled visa holder? If partner can get through the immigration gate even without the principal applicant, then your plan, though circuitous, is not impossible.IF THEY LET YOU THROUGH.
a visa does not guarantee entry through the border if your circumstances are dubious like why the partner and NOT the principal applicant. if you say that its because you think PA has lesser chance of getting a job than you, and PA is skilled then who is to say you will get job faster when its the PA's chances that were judged and not the PA's partners. in my humble opinion... good luck with your plans.
"and he/she finds a fulltime job, he can apply for Work Visa and can legally work there on that basis. if you get a job here for LTSSL or other skilled work you wont be applying for a WTR. its direct residency. WTR is for people not here yet and immigration thinks they have a certain chance of getting skilled work for SMC. If you already have a skilled job here, you apply for residency.
if you get a job here but its not skilled, you apply for a work permit and have it renewed as it expires and renew it over and over for as long as its not skilled. work permits needs to be justified all over again when renewing. actually its not really renewing its always a new application with the same requirements sent all over again as if it was never approved before.
if the partner get a job here because they let him/her through the border on an open permit, the partner's open permit will expire if the PA does not make it into NZ before PA's visa expires.
when the WTR is approved there is a date by which the principal needs to be in the country before it expires.
partner's visa tied up with principal so even if partner gets in and gets a stamp for 9 months entry, if principal's visa expires bec principal did not enter, the partner's visa automatically expires even if its not stamped on the passport.
so i really doubt partner can even come into the country if the principal does not come in first or together with the partner who intends to get the job. |
